This document describes the terms and conditions and the privacy policies applicable to the use of the services offered by Hannia Char Artwear within the website www.hanniachar.com and other related domains. Any person who subscribes to www.hanniachar.com or wishes to use the services offered, has every right to do so but must abide by the Terms and Conditions and the Privacy Policies pre-established in the document. These terms and conditions of sale will be determined in accordance with the applicable laws in the Republic of Colombia. Any controversy that derives from this document will be submitted to the competent jurisdiction in accordance with Colombian legislation, and both Hannia char Artwear and the client expressly waive any other jurisdiction that may correspond to them by reason of their present or future domicile.

It is necessary for the user to read, understand and accept all the conditions established in this document prior to registering as a user or purchasing products or services through www.hanniachar.com. By using this site, the user is fully accepting the conditions established in the Terms and Conditions and the Privacy Policies of Hannia Char Artwear m and therefore, the user is obliged to comply with all the pre-established conditions without being able to claim ignorance of such Terms and Conditions and Privacy Policies.

SECTION 1 – LEGAL CAPACITY

The services offered by Hannia Char Artwear are only available to people who have the legal capacity to contract. The acts that minors perform on this site will be the responsibility of their parents or guardians and therefore, will be considered as performed by them and the legal representation they have. Who decides to register a user as a company, must have full capacity to contract on behalf of the entity and consequently, oblige the same to the terms established in the document “Terms and Conditions”.

SECTION 2 – REGISTRATION AND USE OF THE SITE

SECTION 3 – MODIFICATIONS TO THE AGREEMENT

Hannia Char Artwear may modify the Terms and Conditions at any time. The modified terms will become effective 10 days after their publication. Within the first 5 days after publishing the new modifications, the user must contact www.hanniachar.com by email if they do not accept the new Terms and Conditions. In case you do not accept them, the user will be disabled as a member. If the 5-day period expires, the user will be deemed to accept the new Terms and Conditions and the contract between both parties will not be affected.

SECTION 4 – PAYMENT MEDIA

The payment methods available on the www.hanniachar.com can website are:

• Online payments (credit or debit card) through the Openpay payment gateway.

From our Ecommerce we do not capture, store or transmit data transactional. For this we have the services of Openpay, which is a platform of certified payments; that guarantees the security of all transactions through software encryption, validation procedures and robust data protection measures to
banking level (PCI level 1 certification). That is why making payments on our website is sure.

The products and services offered on www.hanniachar.com can only be paid with the means indicated in each specific case. The use of a credit card is subject to what is established in these Terms and Conditions and to what has been agreed in the respective cases of opening contracts and use regulations with its issuer. Hannia Char Artwear may determine purchase conditions according to the payment method chosen by the user. Hannia char Artwear has the right to determine the maximum amount of credits that the user can use per purchase and the user will be notified prior to initiating the payment process. The credits that are used by the users will not be refunded in case of return of the products.

SECTION 5 – FORMATION OF CONSENT IN CONTRACTS CONCLUDED THROUGH THIS SITE

Through www.hanniachar.com, offers of goods and services will be made that can be accepted using the mechanisms offered. Any acceptance of the offer by a user is subject to suspense until the transaction is validated. For any operation that is carried out on www.hanniachar.com, validation by the supplier is a requirement for the formation of consent. SECTION 7 – PROMOTIONS

The promotions offered on www.hanniachar.com will not be valid on other sales channels. When promotions are made that consist of lowering the price or sending a product free of charge for the purchase of another, the two products must be delivered to the same site. Suppliers submit their promotions to the provisions of Law 1480 of 2011.

When discount coupons are offered, the value of the coupon, the minimum purchase amount to use the coupon and the dates on which it can be used will be clarified. Any natural person over 18 years old can use coupons. Coupons cannot be combined with other promotions and can only be used once per customer. The maximum purchase amount for the use of coupons is 1 million pesos.

SECTION 8 – DISPATCH OF PRODUCTS

Products purchased through our Marketplace Hannia Char Artwear are subject to the dispatch conditions chosen by the user and the delivery conditions available in our Marketplace. The time stipulated for dispatches will be:

1. National shipments:

• 3 to 10business days.

1. International deliveries:

• 7 to 12 business days.

TERMS OF USE

• The user will freely choose the address of the place of delivery.
• After the payment is approved and the order is dispatched, Hannia Char Artwear will notify the customer by email of the delivery date of their order. In the event that no one receives the order at the shipping address, a second attempt will be made within the next three days.
• If after this attempt no one receives the order, the user must contact the email [email protected] and the cost of the new shipment is assumed by the customer.
• If the customer does not make a new shipment within the next 5 days after the second attempt, the product is declared in a state of abandonment and there will be no compensation.

Note: In this case, Hannia Char Artwear will not be responsible for the products not received.

It is understood that any person who is in the place indicated by the client for the delivery of the products is authorized to receive the order, therefore, MC DEVINS SAS is exonerated from any claim derived from the delivery that takes place in the place indicated by the client.

• Purchases made in Colombia with international shipping addresses are subject to the collection of the shipping cost.
• Hannia Char Artwear is not responsible for additional charges in the customs of the respective countries, when shipments are international.

SECTION 9 – RETURNS.

GUARANTEE

Our garments have a 1 month warranty from the moment our customers receive the product. After this time, merchandise claims are not accepted for any reason. In the event of a warranty claim, our quality department will proceed to review it and we will respond within 8 business days. (See requirements for changes).

In case the garment can be repaired, it will be done or otherwise it will be changed. The garment sent for guarantee must be washed before sending it for claim.

For the warranty claim, it must be requested to our email hanniachar.com or to our WhatsApp +54 91126893067, from Monday to Friday from 8:00 a.m. at 5:00 p.m.

GENERAL REQUIREMENTS FOR WARRANTY AND / OR RETURNS.

• Undergarments DO NOT HAVE CHANGES due to hygiene. This applies to all our products, except for products on which it is intended to seek the guarantee for defects in the garment.
• The product cannot be modified from its original state.
• The product must be in perfect condition: unused, clean, and in its original packaging with original labels and tags.

WRONG PRODUCTS

If the Customer receives a product with different characteristics to those described on the page at the time of purchase, the procedure to request a product change is as follows:

• Within 2 days after receiving the product, the customer must take photos that show the wrong product and send them to the email www.hanniachar.com with the order number.
• Once it is verified that a wrong product arrived, a collection guide will be sent to the customer and Hannia Char is responsible for collecting the product in the same place where it was delivered and once the wrong product is collected, the correct product will be sent.

CANCELLATIONS

The cancellation of a purchase is only made if the supplier is unable to send the product to the customer due to lack of inventory and/or other force majeure reasons. If this happens, the client will be notified and the money will be returned. The refund of the money varies depending on the payment method used. The customer can choose between the following refund methods:

• Voucher: the vouchers are valid for one year and must be used in a single purchase. The delivery time for this refund is 2 business days.
• Bank Deposit: The account holder must be the same one who made the purchase at www.hanniachar.com. The refund will be made in 3 business days.

To cancel an order for any reason, the customer must write an email to hanniachar.com with the order number they wish to cancel. Orders can only be canceled if they have not yet been sent by the provider or in the event that it has been charged by the PAYPAL, the client assumes the commission costs generated.

SECTION 10 – INTELLECTUAL AND INDUSTRIAL PROPERTY
